Is the VL 3 with fixed gear and fixed pitch propeller and a Rotax 914 turbo, considered an LSA?

Yes, it may very likely qualify but you’ll need to ask Alion Aviation for details. If it has retractable or an adjustable prop, it must remain an Experimental-Amateur Built for now, but with the new regulations, it may (should?) qualify.
